Deferred Action for Childhood Arrivals (DACA)
UPDATE* USCIS started to accept new DACA applications. If you are a DACA recipient and you are seeking a renewal or would like to apply for the first time, please contact our office today, to consult about your eligibility and your options.
Under the Deferred Action for Childhood Arrivals (DACA), certain people who came to the United States as children and meet several guidelines may request consideration of deferred action for a period of two years, subject to renewal. They are also eligible for work authorization. Deferred action is a use of prosecutorial discretion to defer removal action against an individual for a certain period of time. Deferred action does not provide lawful status.
A person can be eligible for DACA if they:
-
Were under the age of 31 as of June 15, 2012;
-
Came to the United States before their 16th birthday;
-
Were physically present in the U.S. on June 15, 2012 and when applying for DACA;
-
Had no lawful status on June 15, 2012;
-
Have continuously resided in the U.S. since June 15, 2007 until the present;
-
Meet certain educational requirement or were honorably discharged from the U.S. Armed Forces
-
Have not been convicted of certain crimes
